Messrs. Wolfskill and Polk were added to the committee on new counties. On motion of Mr. Anderson,

Resolved, That a committee of five members he appointed to take into consideration the message of the Governor, communicated to the Senate on the 18th of this month, for the purpose of referring the several subjects therein contained to the appropriate committees, and report the same to the Senate. Whereupon the President announced Messrs. Anderson, Massey, Jones, Ellis and Lucas as said committee.

Mr. Jones gave notice that on Monday next, or some day thereafter, he would introduce a bill to amend the eighth article on the law of administration, concerning appeals from the county courts to the circuit courts, approved March 21st, 1835, so that no bill of exceptions shall be required to entitle a party to take an appeal from the decision of a county court to the circuit court.

Mr. Massey, on leave, introduced

A bill to provide for assessing the taxable property of this State and for making lists of the same.

Which was read a first time, and

On motion, the rule being suspended, was read a second time.

Mr. Massey moved to refer the bill to the committee of Ways and Means, and that it be printed.

Mr. Fort moved to amend the motion by adding the following:

And that the committee of Ways and Means be instructed to retain said bill until they have an opportunity to compare the same, with the bill prepared by the commissioners on revision.

Which was rejected.

The question then recurred on the motion to refer and print, and was determined in the affirmative.

Mr. Polk on leave of the Senate, introduced,

A bill concerning bank directors.

Which was read a first time, and ordered to a second reading.

Mr. Fort submitted the following,

Whereas the late Governor of the State of Missouri recommended the 28th inst., (to-morrow,) to be observed by the people of the State of Missouri, as a day of thanks giving.

Therefore resolved, by the Senate, that when it adjourns for the day, it shall stand adjourned, until Friday, and that the lergy, or the preachers of the Gospel now in the City, be requested to perform divine service in the Senate chamber on to-morrow, commencing at 11 o'clock, A. M.

Mr. Monroe, on leave, of the Senate introduced

A bill supplemental to an act entitled "an act to survey and mark out the southern boundary line of this State, approved February 11, 1841.

Which was read a first time, and on his motion the rule was suspended, the bill read a second time, considered as engrossed, read a third time and passed.

Message from the House of Representatives, by Mr. Huston:

MR. PRESIDENT,

I am instructed by the House of Representatives to inform the Senate, that the following bills have been introduced into the House:

A bill divorcing Polly Nichols, from her husband John Nichols.

A bill to repeal an act approved, Feb. 24, 1843, entitled an act amendatory

of an act to regulate marks and brands, approved Feb. 26, 1835.

A bill for the relief of Russell W. Moss, late sheriff of Shelby county.

A bill to organize the county of Atchison, and to define the boundaries of the

same.

A bill to organize the county of Harrison.

A bill for the relief of Isaac Peervy, collector of Barry county.

A bill to organize Oregon county.

A bill to organize the county of Dunklin.

A bill for the relief of Samuel D. Lucas.

A bill for the relief of the collector of Wayne county.

A bill to establish a State road from John Warren's in Jefferson county, to Jackson in Cape Girardeau co.

A bill for the relief of Peter Apperson.

A bill to incorporate the south-eastern levying and draining company, of Missouri.

A bill for the relief of the collector of Jefferson county, and

A bill for the repeal of the stray law in Jefferson county.

The following bill has been rejected by the House:

A bill to regulate the appointment of Assessors of the revenue.
On motion of Mr. Monroe,

Resolved, That a committee of five be appointed to whom shall be referred so much of the Governor's message, as relates to the annexation of Texas to the United States and the occupation of Oregon.

Mr. Acock submitted the following:

Resolved by the Senate, That the committee on Internal improvements, be instructed to report a bill to apply the proceeds of the 500,000 acres of land, donated to the State of Missouri for purposes of internal improvements as follows:

1. For the improvement of the Osage river

2. For the improvement of North Grand river 3. For the improvement of White river

4. For making a road from Hannibal in Marion county, to some convenient point on the Missouri river

The Senate adjourned till two o'clock.

EVENING SESSION.

The Senate met pursuant to adjournment.

The President announced Messrs. Monroe, Fort, Ellis, Welborn and Wolfskill as the committee under the resolution adopted in reference to so much of the Governor's message as relates to Texas and Oregon.

On motion of Mr. Massey,

Two members were added to the said committee, consisting of Messrs. Nethérton and Jones.

On motion of Mr. Monroe,

The amendments proposed to the constitution of the State of Missouri by the twelfth General Assembly were taken up and read a third time,

On motion a call of the Senate was ordered when all the members were

found to be present, except Messrs. Detchemendy, Hudspeth, Miller, Netherton and Shelton, thereupon,

On motion the Sergeant at arms was despatched after the absentees, when On motion of Mr. Monroe,

The said constitutional amendments were passed over for the present,

A bill to establish a fifth branch of the bank of the State of Missouri,

Was read a second time, and

On motion of Mr. Boggs,

Referred to the committee of the whole.

A bill to distribute the proceeds of the sales of the land donated to this State by Congress,

Was read a second time, and

On motion, referred to the committee of the whole.

A bill to amend an act entitled an act regulating marriages, approved February 20th, 1835,

Was read a second time, and

Referred to the committee on the judiciary.

Amendments te the constitution of the State of Missouri, in relation to the incorporation of religious societies,

Were taken up and read a third time.

The question was taken on the adoption of said amendments which are as fol lows:

Resolved, by the Ceneral Assembly of the State of Missouri, as follows:

§ 1. That the following be proposed as an amendment to the constitution of the State of Missouri, to wit: "provided however, that persons, members of religious societies may be incorporated for the purpose of holding sufficient ground, not exceeding, in incorporated towns or cities, one lot, in villages, two lots, in the country ten acres, for the erection of a church, or meeting house, parsonage and burial ground, for the benefit of the society."

To be added at the end of the fifth section of the thirteenth article.

And a constitutional majority of two thirds agreeing thereto, the same were adopted by the following vote:

Yeas.-Messrs. Acock, Anderson, Boggs, Campbell, Calhoun, Detchemendy, Ellis, Fort, Hancock, Harper, Harris, Johnson, Jones, Mills, Monroe, Netherton, O'Bryan, Powers, Rawlins, Reese, Snyder: Welborn and Wolfskill-23. Nays.-Messrs. Blythe, Gentry, Hudspeth, Lucas, Massey, Polk, Snell and Thompson.-8.

Absent, Mr. Miller.

Sick, Mr. Shelton.

The house bill entitled a bill for the relief of the collector of Perry county. Was read a first time, and ordered to a second reading,

On motion of Mr. Fort,

The amendments to the constitution of the State of Missouri in relation to Judicial tenures,

Were taken up.

Mr. Boggs moved to take the vote on said amendments by sections,

Which was decided in the affirmative.

On motion of Mr. Monroe,

A call of the House was ordered, when all the Senators answered to their names except Mr. Shelton.

The President presented a communication from the Secretary of State in relation to weights and measures, which, with a copy of a letter from the Treasu ry department of the United States, was

Referied to the committee on Agriculture.

Also, a communication from the Auditor of Public Accounts, transmitting his biennial report, which

On motion, the reading being dispensed with,

Was referred to the committee of Ways and Means,

And one thousand copies ordered to be printed for the use of the Senate. Messrs Campbell and Blythe on their several motions were excused from serv ing on the committee appointed to contraet for and superintend the job printing of the Senate.

The President appointed Messrs. Miller and Lucas on said committee.
Mr. Fort moved to adjourn, which was negatived.

Mr. Miller, on his motion, was excused from serving on the committee appointed to contract for and superinted the job printing of the Senate, and The President appointed Mr. Massey in his place.

On motion the Senate adjourned until Friday morning at ten o'clock.

Message from the House of Representatives, by Mr. Huston.

MR. PRESIDENT:

I am instructed by the House of Representatives to inform the Senate that the following bills have been introduced into the House: An act to McAdamize a road across the big swamp, between the counties of Scott and Cape Girardeau.

An act to authorize the administrators of the estate of Nicholas Burkhart, deceased, to sell real estate.

An act to extend the corporate limits of the town of Columbia in Boone county, and for other purposes.

An act to authorize Edward Berry to build a mill dam across South Grand river.

An act for a change of a State road.

The following bill passed the House:

An act to authorize John Jacobs, treasurer of Shelby county to draw certain monies belonging to said county.

Mr. Rawlins, from the committee on enrolled bills, reported as truly enrolled, An act to appropriate money.

Also, a joint resolution authorizing the Secretary of State to withhold the returns of his abstract of the census until he shall have received complete returns from all the counties in the State.

Mr. Snyder from the select committee, appointed to contract for and superintend the job printing of the Senate,

Reported, that the committee had contracted with Calvin Gunn for the printing of four thousand copies of Governor Marmaduke's message for $20,00 and with James Lusk for a like number of the Inaugural address of Governor Edwards, for $46,00.

Which was read.

Mr. Polk gave notice that he would on Monday or some subsequent day, ask leave to introduce a memorial to Congress, on the subject of the Oregon territory, also

introduce a bill respecting circuit and supreme judges,
