WEDNESDAY MORNING, December 11, 1844.

The Senate met pursuant to adjournment.

Mr. Lucas presented the petition of sundry citizens of St. Louis county, praying for the incorporation of the Franklin fire company;

Which was read and referred to a select committee, consisting of Messrs. Lucas, Mills and Monroe.

Mr. Ilancock, from the committee on claims, to whom was referred

A bill for the relief of William Thrailkill,

Reported it back without amendment, and recommended its passage.
The report was read and agreed to, and

The accompanying bill read a third time.

Mr. Monroe moved to amend by way of ryder as follows:

In section 3, line 1st, strike out the word "bill," and in lieu thereof insert the word "act."

Which was read three several times, and

The bill as amended passed.

On motion of Mr. Ellis,

The concurrent resolutions in relation to the appointment of a committee to examine the condition of the State University,

Were taken up, and

On motion of Mr. Boggs,

A call of the House was ordered, when the number of Senators present was 32; absent, Mr. Gentry-1.

Whereupon the Sergeant at Arms was despatched to notify Mr. Gentry.
On motion of Mr. Thompson,

The resolutions were laid on the table.

An act to establish a State road from John Warren's in Jefferson county to Jackson in Cape Gi. ardeau county.

An act for the relief of the collector of Cape Girardeau county.

An act to authorise Edward Berry to build a mill dam across south Grand river.

An act for the relief of Russell W. Moss, late sheriff of Shelby county.

The House has passed the Senate bill entitled,

A bill supplemental to an act entitled an act to survey and mark out the southern boundary line of this State, approved Feb. 11, 1841.

The House has passed the following revised statutes.

An act regulating the mode of taking the census.

An act concerning depositions.

An act regulating the removal of officers by address.

An act to enable counties to make contracts and hold and convey real estate. An act respecting the Attorney General, circuit and county attornies.

An act concerning attornies at law.

The House has concurred in the resolutions of the Senate, instructing the committee appointed to settle with the Auditor and Treasurer in relation to wolf scalp certificates.

The Speaker has signed the enrolled bill entitled an act to authorise the administrators of Nicholas S. Burckhart deceased, to sell real estate.

Whereupon it was signed by the President of the Senate and transmitted to the Governor for his approval and signature.

On motion of Mr. Thompson,

The amendments to the constitution of the State of Missouri, proposed by the twelfth General Assembly in relation to the limitation of judicial tenures, Were taken up and read a third time, when

A call of the House was ordered, and all the Senators found to be present. Mr. Fort moved the previous question on the passage of the first section of the amendments.

Which was determined in the affirmative by the following vote:

Yeas-Messrs. Acock, Anderson, Blythe, Boggs, Detchemendy, Fort, Hancock, Harper, Hudspeth, Johnson, Jones, Massey, Miller, Monroe, Polk, Powers, Rawlins, Reese, Snyder, Thompson, Welborn and Wolfskill--22.

Nays-Messrs. Campbell, Calhoun, Gentry, Harris, Lucas, Mills, Netherton, O'Bryan, Shelton and Snell-10.

The question then recurred on the adoption of the first section of the amendments to the constitution,

Which was decided in the affirmative by the following vote:

Yeas-Messrs. Acock, Anderson, Blythe, Boggs, Detchemendy, Ellis, Fort, Hancock, Harper, Hudspeth, Johnson, Jones, Massey, Miller, Monroe, Netherton, Polk, Powers, Rawlins, Reese, Shelton, Snyder, Thompson, Welborn and Wolfskill-25.

Nays-Messrs. Campbell, Calhoun, Gentry, Harris, Lucas, Mills, O'Bryan and Snell-8.

The constitutional majority of two-thirds having voted for the adoption of the first section the same was declared adopted.

The question was then taken on the adoption of the second section of the amendments and was decided affirmatively by the following vote:

Yeas-Messrs. Acock, Anderson, Blythe, Detchemendy, Ellis, Fort, Hancock, Harper, Hudspeth, Johnson, Jones, Massey, Miller, Monroe, Netherton, Polk, Powers, Rawlins, Reese, Shelton, Snyder, Thompson, Welborn and Wolfskill-24.

Nays-Messrs. Boggs, Campbell, Calhoun, Gentry, Harris, Lucas, Mills, O'Bryan and Snell--9.

The constitutional majority of two-thirds having voted for the adoption of the second section, the same was declared adopted.

The question was then taken on the adoption of the third section of the

amendments, and was decided in the affirmative by the following vote:

Yeas.-Messrs. Acock, Anderson, Blythe, Boggs, Detchemendy, Ellis, Fort, Hancock, Harper, Hudspeth, Johnson, Jones, Massey, Miller, Monroe, Nether ton, Powers, Rawlins, Reese, Shelton, Snyder, Thompson, Welborn and Wolfskill-25.

Nays.-Messrs. Campbell, Calhoun, Gentry, Harris, Lucas, Mills, O'Bryan and Snell--8.

The constitutional majority having voted for the adoption of the third section, the same was declared duly adopted.

On motion of Mr. Jones,

Resolved by the Senate, That the Secretary be authorised to purchase a suitable desk or case, in which to preserve the files of the Senate during the session, to be paid for out of the iconey appropriated for contingent expenses.

Mr. Hudspeth gave notice that he would, on to-morrow, ask leave to introduce,

A bill for the relief of the collectors of the revenue, generally.

Mr. Shelton gave notice that he would, on Thurs lay next, or some day thereafter, introduce a bill to repeal the present grocery law.

Mr. Snyder gave notice that he would, on to-morrow, or some subsequent day, ask leave to introduce a bill to change the mode of assessing and collecting the revenue.

On motion, the Senate adjourned, until to-morrow morning at nine o'clock.

THURSDAY MORNING, December 12, 1844.

The Senate met pursuant to adjournment.

On motion of Mr. Fort,

The business and orders of the day were passed over, and the Senate resolved itself into a committee of the whole,

Mr. Monroe in the chair;

And after some time spent therein,

The committee rose, and reported through their chairman,

That they had had under consideration,

An act regulating the action of account,

And reported the same to the Senate without amendment, and recommended its passage. Also,

An act concerning advertisements;

And reported the same with an amendment, and recommended its passage. An act concerning apprentices,

And reported the same without amendment, and recommended its passage. Also, joint resolutions in relation to the annexation of Texas, and that the committee had adopted a substitute for said resolutions, and recommended its passage. The committee further asked to be discharged from the consideration of the subjects aforesaid;

Which report was read and agreed to.

On motion of Mr. Fort,

The substitute for the joint resolutions in relation to the annexation of Texas Was taken up and read,

Mr. Lucas moved to amend the substitute as follows:

Resolved further, That our Senators be instructed and our Representatives requested to maintain the tariff of 1842, for the protection of American industry.

Which was decided by the President to be out of order.

Mr. Anderson moved to amend the substitute as follows:

In the first line of the 6th resolution strike out the words "and preserve the peace and harmony of the union.

Mr. Boggs moved to postpone the further consideration of the substitute and amendment until Monday next,

Which was rejected.

Mr. Boggs moved to postpone the consideration of the substituted resolutions and amendment until Saturday next;

Which was negatived by the following vote:

Yeas.-Messrs. Anderson, Boggs, Campbell, Calhoun, Detchemendy, Ellis, Harper, Lucas, Miller, Mills, Netherton and O'Bryan-12.

Nays--Messrs. Acock, Fort. Gentry, Hancock, Harris, Hudspeth, Johnson, Jones, Massey, Monroe. Polk, Powers, Rawlins, Recse, Shelton, Snell, Snyder, Thompson, Welborn and Woliskill-20.

The question then recurred on the adoption of the amendment, and was decided in the negative by the following vote:

Yeas.-Messrs. Anderson, Boggs, Calhoun, Detchemendy, Fort, Netherton and Rawlins--7.

Nays.-Messrs. Acock, Campbell, Ellis, Gentry, Hancock, Harper, Harris, Hudspeth, Johnson, Jones, Lucas, Massey, Miller, Mills, Monroe, O'Bryan, Polk, Powers, Reese, Shelton, Snell, Snyder, Thompson, Welborn and Wolfskill-25.

Mr. Ellis moved to strike out the 6th resolution of the substitute,
Which was determined in the negative by the following vote.

Yeas.-Messrs. Anderson, Boggs, Campbell, Calhoun, Detchemendy, Ellis, Gentry, Harris, Lucas, Mills, Netherton, Rawlins and Snell-13.

Nays-Messrs. Acock, Fort, Hancock, Harper, Hudspeth, Johnson, Jones, Massey, Miller, Monroe, O'Bryan, Polk, Powers, Reese, Shelton, Snyder, Thompson, Welborn and Wolfskill-19.

On motion of Mr. Monroe, the vote was then taken on the passage of the substitute, which was determined in the affirmativę.
